Terms of Use
The agreement between you and Mercurios when you use Wayfinder.
Effective from September 03, 2026
These terms govern your use of Wayfinder, published by Filipe Daniel Fonseca dos Santos, sole proprietor (MEI), CNPJ 21.477.667/0001-50, trading as Mercurios Comércio, Tecnologia e Análise de Dados ("Mercurios", "we"), of São Paulo, Brazil. By creating an account or using the app, you accept them. If you do not agree with something here, do not use Wayfinder.
The Privacy Policy is part of this agreement.
This English text is a translation provided for convenience. If the two versions differ, the Portuguese version governs.
Who may use it
You must be 18 or older. Wayfinder is for personal use — your own planning, including your professional life. Do not use the app to provide a service to others without our written agreement.
Your account
You are responsible for keeping your password and your device secure, and for everything done through your account. The email address you register must be one you actually control: it is how we reset your password and reach you about the service. If you believe someone else has had access to your account, tell us at [email protected].
Software under test — read this section
Wayfinder is distributed as pre-release software, under test. That means:
- it is offered for use and evaluation, not as a finished product;
- it contains defects, some of them known;
- data loss, corruption or reset is possible, including from changes to the database structure between versions;
- features may change, be removed or stop working without notice;
- the testing period may end, and access may be withdrawn, at any time.
Do not use Wayfinder as the only record of anything you cannot afford to lose. Keep your own copy of anything important.
Wayfinder is not professional advice
Wayfinder is a planning tool. The method it implements — life areas, values, mission, vision, milestones, goals, habits and review sessions — is a structured way of organising your own thinking. It is not:
- medical, psychological or psychiatric advice or treatment;
- financial, investment, tax or legal advice;
- career guidance by a licensed professional.
Any guidance, suggestion or check shown inside the app is informational only. Decisions about your life, health, money and work are yours. If you are going through difficulty with your physical or mental health, please see a qualified professional.
Your content stays yours
Everything you write in Wayfinder — areas, values, mission, visions, milestones, goals, habits, notes, lists and plans — belongs to you.
You grant us only the licence the app needs in order to work: to store, copy, transmit and display that content back to you, to sync it between your devices and to keep it in backups. This licence exists solely to operate the service for you, and it ends when you delete the content or the account, subject to the retention periods in the Privacy Policy.
We do not publish, sell or share your content, and we do not use it to train AI models.
You are responsible for having the right to store what you write and for that content not breaking the law.
Acceptable use
Do not use Wayfinder to:
- break the law, or store unlawful material;
- try to access other people's accounts or data;
- probe, overload or disrupt our systems, or bypass authentication, rate limits or sync protections;
- reverse engineer, decompile or extract the source code, beyond what the law expressly permits;
- resell, sublicense or provide the service to others;
- create accounts or generate load by automated means, beyond normal individual use.
We may suspend or terminate accounts that breach this section.
Our intellectual property
The app, its code, its design, its visual identity, the Wayfinder name, and the written method and documentation behind it are ours and protected by intellectual property law. Subject to these terms, we grant you a personal, non-transferable, non-exclusive, revocable licence to use the app on devices you own or control. Nothing here transfers any ownership in Wayfinder to you.
Price
Wayfinder is free of charge during the testing period. We may introduce paid plans in the future. If we do, we will tell you in advance, and the free use you already have will not be converted into a paid subscription without your express agreement. Any purchase made through an app store is also governed by that store's terms.
Availability and changes
We work to keep the service running, but we do not guarantee uninterrupted availability. We may change, suspend or discontinue any part of the service. Where a change materially reduces something you rely on, we will give reasonable notice where we can — during the testing period, notice may be short. If the service is shut down entirely, we will tell you in advance and you may ask for a copy of your data before it is removed, as described in the Privacy Policy.
Ending the agreement
By you: you can stop using Wayfinder and delete your account at any time, from the app or by email, as described on the Account and Data Deletion page.
By us: we may suspend or end your access if you breach these terms, if the law requires it, or if we discontinue the service. Except in the case of a breach, we will give reasonable notice and, where we can, the chance to obtain a copy of your data.
On termination, your licence to use the app ends. Deletion of your data follows the periods in the Privacy Policy.
Disclaimers
To the extent the law allows, Wayfinder is provided as is and as available, without warranties of any kind, express or implied — including fitness for a particular purpose, accuracy or freedom from error. We do not warrant that the service will be secure, uninterrupted or error-free, or that data will not be lost.
Nothing in these terms excludes liability that the law does not allow to be excluded.
Limitation of liability
To the extent the law allows:
- we are not liable for indirect, incidental or consequential damages, or for lost profits, lost opportunity or loss of data;
- our total liability arising from these terms is limited to the greater of (a) the amount you paid us in the twelve months before the event and (b) BRL 100.
Because the service is free today, this allocation of risk reflects what it is.
If you are a consumer, these limits apply only to the extent the Brazilian Consumer Defence Code and the law of your country allow. Your rights as a consumer are not affected by these terms.
App stores
If you obtained Wayfinder from Google Play, that store's terms also apply. The store is not a party to this agreement and has no obligation to provide support or maintenance for the app.
Changes to these terms
When these terms change, we update the version and effective date at the top. For material changes, we will tell you in the app or by email before they take effect. Continuing to use Wayfinder after that means you accept the updated terms; if you do not, you may delete your account.
Governing law and disputes
These terms are governed by the laws of Brazil. Disputes are subject to the courts of the consumer's home district where consumer law so requires, and otherwise to the courts of São Paulo, SP, Brazil.
If you use Wayfinder outside Brazil, the consumer-protection rules of your country that cannot be set aside by contract continue to apply to you.
General
- Entire agreement. These terms and the Privacy Policy are the whole agreement between us about the service.
- Severability. If a clause is found invalid, the rest remain in force.
- No waiver. Not enforcing a right does not waive it.
- Assignment. You may not assign these terms. We may assign them in a reorganisation, merger or sale of the business, on notice to you.
